Trading Terms

Omega Graphix is an independent design studio located in Penrith, NSW and specialises in graphic design for both print and web as well as providing affordable printing services and web site hosting solutions via our trusted business partners.

Payment Terms:

A deposit of 20% is required for some projects, with the balance due at completion of the project.

Omega Graphix’s Rights:


Omega Graphix reserves the right to:

  1. not to do business with any customer deemed to be a risk for bad debts.
  2. refuse any work which is deemed to be illegal or offensive in any part.
  3. cancel its services to any customer at any time.

Quotations:

Quotations are firm for 30 days after date of quote subject to sighting of material. Afterwards they are subject to any increases in charges/fees or print costs. Additional changes or departure from the brief will charged at the normal production rate.

Job Approval:

All care is taken in producing art and it is checked thoroughly to the best of our ability. But it is the sole responsibility of the Client or their Agent to proofread and check their work during all stages of development and to notify Omega Graphix immediately in writing by return fax or email of any corrections, alterations or proposed amendments. All artwork must be signed off as approved before going to print.

Approval of artwork:

Please note that email correspondence is considered written confirmation on design signoff, project commencement and approval to proceed on a project and requirements.

Also note that a verbal instruction given by the Client to Omega Graphix to hand the file off to a printer for printing constitutes acceptance by the Client that they have checked the document carefully for errors and admissions and therefore Omega Graphix will not accept any responsibility for errors or omissions after a Client has given either a written or verbal approval to proceed with printing or delivery to a Newspaper for publication.

Late Design Changes:

Whereby the Client or their Agent requests further modifications or changes after the completed work has been sent off for printing the Client or their Agent agrees to pay additional costs that may arise.

Colour Variations:

Colour variations between proofs and the finished product is quite common. Where practical only CMYK colour breakdowns are used in the design process of full colour brochures etc. Colours also change when printed on different paper stocks due to the absorption of the inks. If exact colour reproduction is deemed crucial, a highly accurate colour proof will be supplied for an extra charge. This may add a day or two to production time. Please note that inkjet or email proof colours are an indication only and may differ slightly from the finished printed article.

Artwork Production Time:

Artwork production time is generally between 24 - 48 hours for small or medium size jobs. However this may vary according to the current workload.

Deadlines:


Omega Graphix will not be held responsible or delays caused by factors outside our control such as:

  1. the time it takes the customer to supply of all appropriate material necessary for the completion of the job.
  2. the time it takes for the customer to approve any stage of the work.

Printing & Delivery Time:

Please allow 5 - 10 working days for printing and delivery, though not guaranteed.

Product Availability:

Products vary due to print availability and stock. Omega Graphix reserves the right to find suitable alternatives.

Copyright:

It is the Client’s or their Agent’s responsibility to make sure that copyright is not being infringed at all times. Omega Graphix accepts no responsibility for any wilful misleading information or material provided to Omega Graphix by the Client or their Agent which infringes any copyright law.

Canceling design and/or web site development:

Should the Client cancel the project at any stage after project commencement the deposit will be non-refundable regardless of the amount of work produced. Either party may terminate this agreement by giving 7 days notice in writing if the terms of engagement are breached. Should such notice be given, the amount to be paid to Omega Graphix will be based on the amount of work performed at the date of termination.

Legal action will be persued for unpaid invoices.

Ownership of Finished Artwork:

Omega Graphix retains ownership and copyright over all artwork until the full invoiced amount has been paid. Omega Graphix agrees to supply the Client a copy of the completed artwork created and/or used in the production of their printed material upon request.

Portfolio Rights:

The Client or their Agent also acknowledges the right of Omega Graphix to use their work in any promotional material, whether it be in a Publication, Mailer, Television Commercial or Multimedia document (for transmission via disk or email) for the purposes of promoting Omega Graphix.

Liability:

Omega Graphix’s liability is strictly limited to the value of the work carried out for the customer, and will not be liable for any losses direct or consequential due to errors or late delivery.

Web Site Design and Development Terms:

Our web sites are tested in the latest versions of Internet Explorer, Firefox, Safari and Opera browsers on both PC and Macintosh systems. The layout will be optimal in the latest version browsers but may not be fully functional or identical in layout in older version browsers.

Unless requirements are specifically stated in the quotation (prior to project commencement) functionality methods will be produced at the discretion of Omega Graphix.

Web site development does not commence until the following criteria have been met:

  1. that the quotation and the terms and conditions has been accepted
  2. supply of all reference materials (ie. photos, logo, text etc) has been received
  3. full deposit has been received

Omega Graphix will at our expense fix bugs or errors that may arise in our work. This does not cover any alterations or additions to the work produced. Nor does it include rectifying work altered by third party members or problems arising from technical issues with the hosting/server provider.

Source Code used in database driven web site and content management systems:

Omega Graphix retains the IP rights of all source code that it produces and reserves the right to have a copy of the code to re-use in part or whole for future developments.

Well, I'm glad you asked... My name is Peter Loader and I am the proprietor of Omega Graphix which has been in operation business since 1996.

I have been involved in both the printing and advertising industries since 1980 during which I have developed strong design and pre-press skills; which means that whatever the nature of your project it is in good hands.
